The reduction of the amount paid for the obligatory motors’ insurance negotiated by the Costa Rican Insurances Institute with motorcyclists generates doubts on the legalty of the measure. This is because who paid the obligation before the agreement afforded a more expensive amount that the one established afterwards the negotiations. La Nación newspaper consulted Facio & Cañas partner, Víctor Garita, on this subject for an article published on December 1rst, 2011.
The specialist on insurances explained that the hedge is different according to the amount paid by a motorcyclist, in case of a same accident that generates equal injures to others the protection will be dissimilar. “This is a topic from the vision of the consumer, there are drivers that fulfilled the payment before the agreement and now they cannot ask for the reduction”, said Garita.
