Ministry of Finance suggests more flexibility for bank secret

To make easier the access to the country’s bank accounts for tax matter investigations would be the core of a bill of law proposed by the Ministry of Finance, to modify the Code of Tax Regulations and Proceedings. The expert in tax law of Facio & Cañas, José María Oreamuno, collaborated with El Financiero weekly newspaper in its Edition of March 8th of 2010, to clarify the main doubts regarding the changes suggested by the initiative.

The lawyer explained that “the modification eliminates the obligation of the Tax Administration of evidencing in a request of lifting of the bank secret that there are signs of a crime or of grounding itself in the request of a criminal judge to make the petition”. The bill of law to make the bank secret more flexible will reach the Legislative Assembly within the next few days.
