Costa Rica has its own legislation on arbitration that is limited to regulating local issues so experts in the matter recommend updating the Model Law the Model Law as a regulatory standard for the legislation to operate in international cases.
Victor Garita, attorney at Facio & Cañas defends the current Costa Rican law and assures that it should not be overturned or replaced by the Model Law. He suggests that a new chapter should be added to the Law on Alternate Conflict Resolution and the Promotion of Social Peace (the RAC Act) that includes some of the considerations in the international norms to improve how arbitration is regulated.
The Model Law regulates all stages of the arbitration proceeding based on a global census about the more important international trade arbitration issues accepted by the states in all regions of the planet.
Victor Garita insists that it is a mistake to promulgate a new law if the RAC Act already is in place and sustains the hypothesis that Costa Rica could become an international arbitration center if the existing body of law is reformed and adjusted.
