In order to generate alternatives to deal with the problem of infrastructural deficit existing in Costa Rica, and in order to canalize investments in this type of works, the Legislative Assembly approved a partial reform to the General Law on Concession of Public Works with Public Services.
The Law is meant to expedite the contracts for the infrastructure works, besides generating a stronger attraction of investors as well as the administration of strategic public services that the State considers convenient to grant.
This reform authorizes the National Council of Concessions to constitute and use trusts structures to guarantee the correct use of funds to be contributed bythe financial organizations for those projects under the supervision of the Comptroller General of the Republic.
In addition, when the companies require financing, they may guarantee it by constituting a special security in favor of the creditor; this case also requires the prior authorization by the Comptrollers Office.
The purpose is that in the future Costa Rica may have modern infrastructure, by means of projects granted in concession through a fast and secure way.
